Welcome to DivWap!
These Terms of Service (“Terms”) govern your access to and use of DivWap's website, tools, mobile services, and software provided by FluxInnov (referred to as “DivWap,” “we,” “our,” or “us”). By accessing or using DivWap, you agree to be bound by these Terms.
If you do not agree to these Terms, you may not use our services.
1. Use of Our Services
You must be at least 18 years old to use DivWap. You agree to use our services only for lawful business or marketing purposes and in compliance with all applicable laws.
You are responsible for maintaining the confidentiality of your account and any activities that occur under your account.
2. WhatsApp Marketing Compliance
DivWap provides tools to help you send messages via WhatsApp. You agree:
- Not to send spam or unsolicited messages
- To only message users who have given valid consent
- To comply with WhatsApp’s Terms of Service and Business Policy
- Not to use our platform for illegal, abusive, or fraudulent activities
Failure to comply may result in immediate suspension or termination of your account.
3. Account Registration and Security
When registering, you must provide accurate and complete information. You agree to notify us immediately of any unauthorized use of your account at hello@divwap.com.
4. Payment and Subscription
Some DivWap features may require payment. You agree to pay all applicable fees and charges. Prices are subject to change, but we will notify you in advance.
All payments are final unless otherwise stated. Subscription plans renew automatically unless canceled before the renewal date.
5. Intellectual Property
All content, design, logos, and functionality on DivWap are the exclusive property of FluxInnov or its licensors. You may not reproduce, distribute, or exploit any part of the service without our prior written consent.
6. User Content
You retain ownership of the content (e.g., message templates, client lists) you upload. However, by uploading, you grant us a license to use, store, and process this data as necessary to operate our service.
You are responsible for ensuring that your content does not violate any laws or third-party rights.
7. Service Availability
We strive to keep DivWap online and running smoothly but do not guarantee uninterrupted service. We may suspend, withdraw, or restrict availability for maintenance or upgrades without prior notice.
8. Termination
We reserve the right to suspend or terminate your account if you violate these Terms or misuse our service. You may also cancel your account at any time.
Upon termination, you will lose access to your data, and we are not obligated to retain any content or information after account closure.
9. Limitation of Liability
DivWap is provided "as is" and "as available." We do not guarantee that the service will meet your requirements or be error-free.
To the fullest extent permitted by law, DivWap shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service.
10. Indemnification
You agree to indemnify and hold harmless DivWap, FluxInnov, and their respective directors, employees, and affiliates from any claims or liabilities resulting from your use of the service or violation of these Terms.
11. Changes to These Terms
We may revise these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the service after such changes constitutes your acceptance.
12. Governing Law
These Terms are governed by the laws of Côte d'Ivoire, without regard to conflict of laws. Any dispute arising shall be resolved in the competent courts of Abidjan.
